The short version: A freelance residence-permit renewal can require carefully prepared income documentation. The documents requested and the authority's assessment vary by case.
Income Documentation for a Freelance Renewal
Providers offer different combinations of immigration, document and tax support. Before engaging a provider, confirm its role, authority to act and the precise scope of the work.
A useful engagement scope should identify the documents to be prepared, the records required and any communication that is authorized:
Fees and deliverables vary between providers and cases. Ask for written confirmation of the agreed scope, including whether tax-document preparation or communications with an authority are included.
The Five Mistakes Immigration Services Make with Freelance Renewals
Mistake 1: Submitting a tax return instead of a Nettogewinnermittlung
A tax return generally covers a prior reporting period. Current figures may also be relevant to an application, depending on the authority's request. Confirm the evidence required for the individual case.
Mistake 2: No Ertragsvorschau
An Ertragsvorschau is a forward-looking income projection. It may be relevant evidence, depending on the permit and the authority's request. A forecast should be based on supportable records and assumptions.
Mistake 3: Missing or unverified Auftragsbestätigung
A client engagement letter can support an income projection where relevant. The authority decides the form and weight of the evidence in the individual case.
Mistake 4: Confusing Freiberufler with Gewerbetreibender status
The classification of activity can affect tax and residence-permit issues. The applicable treatment depends on the facts and should be reviewed with the relevant rules in mind.
Mistake 5: No direct relationship with the LEA
Appointment availability and processing arrangements are controlled by the LEA and can change without notice. No provider can guarantee a booking or turnaround time.
What Is a Nettogewinnermittlung — and Why It Is Not Optional
The Nettogewinnermittlung (literally: net profit calculation) is the freelancer's equivalent of a payslip. It is a simplified income statement — also known as an Einnahmenüberschussrechnung (EÜR) — that shows:
- Total income received during the period (invoices paid, not just issued)
- Business expenses deducted (home office, equipment, software, professional services, travel)
- Net profit — what remains after expenses, and the figure the LEA uses to assess self-sufficiency
It is not the same as a bank statement. It is not the same as a tax return. It is a structured financial summary covering the current calendar year up to the most recent month before the application.
The authority assesses whether the evidence meets the relevant residence-permit requirements. Any income benchmarks and documentary requirements should be confirmed from current official guidance.
Preparing a correct Nettogewinnermittlung requires access to the applicant's invoices and expense records, knowledge of which expenses are deductible under §4(3) EStG, and the ability to present the result in a format the LEA recognises. This is tax preparation work — not form-filling. It is why an immigration service that has no background in accounting cannot do it reliably.
The Ertragsvorschau: The Document Everyone Forgets
The Ertragsvorschau (income forecast) is a forward-looking document. It shows projected revenue for the next 12 months, based on current client relationships, signed contracts, and reasonable market rates.
An authority may consider a forecast alongside current figures where relevant. Whether either document is required depends on the permit and individual case.
A convincing Ertragsvorschau is not wishful thinking on paper. It is structured around real data:
- Ongoing client contracts with estimated monthly volumes
- Historical revenue as a baseline
- Any confirmed future engagements
- A breakdown by income source that matches the Auftragsbestätigungen submitted alongside it
The Ertragsvorschau and the Auftragsbestätigung must be consistent. If you project €4,000/month in revenue but your only supporting Auftragsbestätigung is from a client who pays €800/month, the officer will ask questions you do not want to answer at the counter.
Submitting Income Documentation
We can support the tax-documentation aspects of freelance residence-permit applications within the agreed scope. The LEA determines appointment availability and application outcomes.
Prepare records before your appointment
Clear, consistent records can help present the facts. The authority may request further documents and controls the application process and timeline.
We prepare every file before it goes to the LEA. No appointment is booked until the complete document set is ready. This is the single most important difference between a service that knows how to handle freelance immigration and one that does not.
The Complete Document Checklist for a Freelance Aufenthaltstitel Renewal
Every case is different, but for a standard freelance permit renewal at the LEA Berlin, the following documents are required:
- Valid passport — clear copy of the data page (high resolution)
- Current Aufenthaltstitel — front and back
- Meldebescheinigung — registration certificate, not older than 3 months
- Nettogewinnermittlung — current year, correctly structured
- Ertragsvorschau — 12-month income projection
- Auftragsbestätigungen — signed engagement letters from current clients
- Health insurance confirmation — current letter from insurer (not older than 3 months)
- Bank statements — last 3–5 months showing regular income inflows
- Vollmacht — if a representative (e.g. TWO.TAX) is filing on your behalf
- Biometric photo — LEA-standard dimensions, recent
- Steuerbescheid — last available tax assessment, as supporting document
For applicants with US income, S-Corp structures, or cross-border situations, additional documentation may be required. This includes translated US tax documents or a German-language summary of worldwide income. This is a step most immigration services cannot assist with — it requires a cross-border tax background.
What TWO.TAX Charges — and What Is Included
Our flat fee for a complete freelance residence permit renewal package is €259 net (€308.21 including 19% VAT). This includes:
- Preparation of the Nettogewinnermittlung based on your income records
- Preparation of the Ertragsvorschau
- Drafting the Vollmacht for LEA representation
- Document review and checklist
- LEA submission coordination
- Follow-up on appointment confirmation
Auftragsbestätigungen from clients must be provided by the applicant — we supply the template and review the final document. For cases with cross-border tax complexity (US income, dual filings, S-Corp structures), additional advisory fees apply.
When to Start the Renewal Process
The Aufenthaltstitel can be applied for renewal up to 3 months before expiry. Given LEA appointment wait times and the document preparation time required, starting 8–10 weeks before the expiry date is the minimum. Starting 12 weeks before is safer.
If your permit has already expired or is within 2 weeks of expiry, the situation becomes more urgent but is not hopeless. German immigration law provides a Fortgeltungsfiktion — the permit is considered to remain valid for the duration of the renewal process as long as the application was submitted before expiry. But this requires that the application is in fact filed on time.
Do not wait. The cost of a late application — in stress, legal uncertainty, and potential work interruptions — is significantly higher than the cost of a well-prepared, timely renewal.
